On April 27 in 2019,the 11th Bauhinia civil action youth salon was held successfully in Yangzhou.The meeting was sponsored by the Society of Civil procedure Law of the Chinese Law Society,organized by the Law School of Yangzhou University and co-organized by the Hanjiang District people's Court of Yangzhou City.This Bauhinia Salon focuses on the issue of civil action enforcement relief.It attracted nearly 60 scholars and doctoral students from dozens of universities including Tsinghua University,Peking University,Renmin University of China,Jilin University,Nanjing Normal University,Southwest University of Political Science and Law,China University of Political Science and Law,China Academy of Social Sciences,East China University of Political Science and Law,Beijing Normal University,Tianjin University,Beijing University of Aeronautics and Astronautics,Beijing Institute of Technology,Tianjin Normal University,Central University of Finance and Economics,Zhongnan University of Finance,Economics and Law,Suzhou University,East China Normal University,Dalian University of Technology,University of Foreign Economics and Trade,Nanjing Audit University,Jiangxi Normal University of Science and Technology,Chongqing University,Jiangsu Normal University,etc.More than 20 executive judges from Yangzhou Intermediate people's Court and Zhenjiang District people's Court participated in the discussion.Professor Fang Shaokun,a special professor of the"Yangtze River Scholars"of Jilin University,was specially invited to give guidance.Professor Zhang Weiping,President of the Society of Civil Litigation Law of the Chinese Law Society,Professor Li Hao,Executive Vice-President,and Professor Xiao Jianguo,Vice-President,Ren Guofan,Deputy Secretary and Executive Vice-President of the Party Group of the Yangzhou Intermediate People's Court,Han Xuefeng,Secretary of the Party Group of the Zhenjiang District People's Court of Yangzhou City,and Professor Wang Chengtang,President of the Law School of Yangzhou University attended the opening ceremony.The opening ceremony was presided over by quShengxia,vice president of Yangzhou University Law School.
The theme is"Civil Execution Relief Research",which consists of three units.The first unit was presided by Professor Fang Shaokun,a special professor of the“Yangtze River Scholars”of Jilin University.Dr.Huang Zhongshun,from Institute of Law of the Chinese Academy of Social Sciences,presented his research findings from three aspects:writing background,basic ideas and supplementary explanations.Professor Lin Jianfeng of the Central University of Finance and Economics,Dr.Liu Dong of the School of Law of East China University of Political Science and Law,Dr.Gu Jiajie of the Center for Comparative Civil Procedure Law of Southwest University of Political Science and Law,and Dr.Cao Zhixun of Peking University commented on the thesis.In the free discussion stage,Professor Zhang Weiping,Professor Xiao Jianguo and more than a dozen experts,scholars and judges explained their views on the speaker's topic from the theoretical and practical dimensions.Professor Fang Shaokun,on the basis of the scholars'discussion,put forward some research suggestions on the debtor's property and how to judge the property right change of the debtor's property from the equal protection of the outsider and the creditor,and made comments and explanations on the substantive problems involved in the study.
The second unit was presided over by Professor Xiao Jianguo of Renmin University of China Law School,and Dr.Liu Ying,Associate Professor of Law School of Beijing University of Aeronautics and Astronautics,is the master of his thesis"The Legitimacy of the Enforcement System and Enforcement"report.The author introduced four aspects containing the legitimacy ensuring of enforcement,the historical origin of enforcement,the institutional model of enforcement and the Chinese propsect of enforcement.In the discussion,Professor Wu Ruqiao of Chongqing University Law School,an associate Professor Zhou Jianhua of Beijing Institute of Technology Law School,Judge XieGuoer of Yangzhou Hanjiang District people's Court,and Associate Professor Pan Xi of Nanjing normal University Law School commented on the report.At the stage of free discussion and postgraduate forum,scholars,judges and graduate students discussed the topic deeply.Professor Xiao Jianguo made comments on this topic and summarized it from the aspects of the way of implementing legalization,the essence of implementing legalization,the right of request and proof of execution,the pre-examination or the hindsight and the obstacles to the application of enforcement.In the third stage of academic summary,Professor Pu Yiwei of Ningbo University made a wonderful and comprehensive arrangement.
Professor Zhang Weiping finally summarized the academic salon.He highly appraised the research of the two reporters and the fruitful findings of the free discussion,and shared his views on the topics,which were from the differences between the legitimacy and illegality of execution in civil law system,the efficiency value of execution,the possible substantive problems of execution objection and the fundamental influence of the difference of registry system and etc.All these have pointed out a more specific direction of the further theory researches.Further theoretical research should be carried out from the practice of China.And the cost of reform and the adaptation and adjustment of the whole court execution system should be paid attention to.President Zhang highly affirmed the keen awareness of the judges and scholars and the enthusiasm for in-depth discussion.At the same time,he expressed his heartfelt thanks to the conference organizers and the co-organizers of the court!The meeting was successfully finished!
